The bottom line is, intent can't be determined from words alone. The Mohammeds didn’t slander anyone, they didn’t harm anyone (like yelling “fire!” in a movie theater, to cause a stampede), and they didn’t threaten anyone (all their plotting was done in private conversations). They took no action that would distinguish their plotting from an author’s. I think they could be jailed only by subverting the first amendment (freedom of speech).
