Military service as a mitigating factor

Should military service in Iraq be a mitigating factor in this case?

That's why I stated that a Judge or jury should be the ones to decide .

you said 'if he did [know there was someone down there] he would be up on charges.

But this is not true. We might not be able to determine if he knew or not. We sure can't tell from the story. And the police might not be able to tell either.

So what other careers should people go into if they want to be exempted from Equal Protection? Maybe doctors should get some advantages, because they save lives? How about teachers, since their job is to mold citizens? High-rise window washers? (After all, they're putting themselves in danger so we can look out the window at the dirty building next door.)

What is the limit on that? Should it apply, without context, to murder? Drunk driving? Parking in a handicapped spot without a permit? Dine & dash?

What if someone told him that someone was down there? What if he saw someone and did try to hit them? That is why a jury , if needed , must decide if he is charged at all.
