Start with this one:

There are ten different kinds of people in this world, those who speak binary and those who don't.

Solve that and the other (poor humour) one will be simple.
 
Well, there are 10 people in the room. 1 is guilty, 0 is not. That's the way it would be with how your question is (you said "one" is guilty, and to think binary, 10 is binary for 2).

Note to you all,

It is not 10 = 2, it is:

10 different kinds of people, those who speak binary and those who don't.
Those who speak binary = 1
Those who don't = 0

Edit: But you are correct, 10 = 2 (in the ascii chart for instance)

The day before yesterday, Alice was 17 years of age. Next year, she’ll be 20 years of age. How is this possible
 
Alice was born on December 31. The day now is January 1st, 2005. Next year, during the year of 2006 she will turn 20.
 
could it perhaps include one of those years with an extra day that i do not know the english word for?
