Although Carter-Murphey had been declared a woman, the 4th State Court of Appeals in San Antonio later ruled in a separate case that sex is determined by chromosomes, not by birth certificate or court order.

Applying that rule, Millard ordered a genetic test last year, writing, "In short, once a man, always a man."

Carter-Murphey appealed but was denied by the 14th State Court of Appeals and the state Supreme Court. In March, Millard again ordered genetic tests, which showed that Carter is still Murphey ? a male.

Why the fuck did they need two genetic tests?...Sex change happens overnight without ones consent that periodical tests must be needed to accurately determine one's "present" gender?....

You know... Just as important as chromosomes in determining birth gender is the hormone androgen. In early weeks of fetal development this is the stuff that makes a male out of a fetus, otherwise it becomes female by default. You can have two X chromosomes and still end up male, or XY and end up female. The precedent of this test is probably going to cause trouble along these lines one of these days. Imagine wanting to divorce your spouse and, having access to medical history, being able to prove that he or she has the same chromosomes for sex that you do, instantly nullifying your marriage. That’s funny.

Conservative reactionarys really aught to be kept out of the loop on discussions of gender as it relates to government policy. They are, for the most part, just chest beating apes who will spout lines like "Once a man alwayse a man" no matter what the doctors say.

He-she married Gonzales four months after changing his-her name and getting legally declared a woman, although wedding photos show Carter-Murphey dressed as a man.
