"The American spy is guilty and must be put on trial in Iran," said Kazem Jalali, a spokesman for Parliament's National Security and Foreign Policy Committee.

what's the bug eyes for? If its the comment about guilt you should pick up todays Adelaide Advertiser and read the article on the parents who are alleged to have staved there disabled child. That was about a bail hearing and unless you read it VERY closely you wouldn't even realise that they hadn't even been tried yet, let alone found guilty

You missed the point.

A spokesman for the Iranian Government has stated that he is guilty.. In other words, his guilt has been pre-determined, which means the trial could end up being a farce.

As for the Adelaide parents who are currently facing a bail hearing. They were the sole carers for their disabled daughter and the young woman died and weighed 12kg's upon her death. Do you really think they had nothing to do with her neglect and starvation? Just saying.. And in their case, no one from the Government has fronted the media and declared them guilty before the trial. That is the major difference between the two.

So presumption of innocence is just liberal hogwash then? Just saying.

Their trial will proceed with the presumption of their innocence. I am allowed my opinion as an outsider and not involved with the upcoming trial. But looking at what has been released to the media so far, it does not look that good for them and unless there is a spectacular circumstance that resulted in their not feeding or providing care for her until she weighed 12kg's, then it could very well be that they are found guilty.

Who knows. We shall wait for the trial.

Since when is the prosecution not a representative of the crown? They didn't state that they are "accused of neglecting x until they died", there wording (as reported) was "they staved x until they died" Huge difference, no doubt, no presumption of innocence

Oh and shall we look at the government (BOTH of them) statements when David Hicks was in Gitmo?

And anyway, is Iran even a presumption of innocence country or is it like Eroupe which has a presumption of guilt system?

Not sure what the laws are on paper, but it scarsely matters. In practice, Iran is a show-trial country when it comes to anything like this. By the time anyone there has been publicly accused of being an American spy, they're already a political football.

How many people are currently in gitmo? How many have been CHARGED? how many convicted?

Think a line about people in glass houses throwing shoes would be apropriate here *rolleyes*

Spies that get caught get anywhere get tried. This is not unique to Iran. Even spies like Bradley Manning get tried.

That's a great point, actually. Lots of Americans wanted that guy literally scalped for data dumping; I bet Sandy would have paid top dollar to watch it from the front row. His treatment, whatever it comes to in the end, might not be the precedent Americans should hope for in this particular case.
